What is the remedy in case of dismissal of Pre-emption Suit?
PLJ 2000 · Peshawar High Court
This case was about a property dispute under pre-emption law, which gives certain people (like neighbors or co-owners) the first right to buy land when it is sold. The buyers (petitioners) had purchased land, and Murtaza Khan, who claimed a pre-emption right, sued for possession of that land. To succeed in a pre-emption case, the claimant must follow specific legal steps: immediately declaring intention to exercise the right upon learning of the sale (talb-i-muwathibat), followed by formally confirming that intention through a witnessed notice (talb-i-ishhad).
The trial court dismissed the suit, ruling that the plaintiff had not properly fulfilled these requirements. However, the appellate court reversed this decision and ruled in favor of the plaintiff, allowing him to take possession of the land by paying the original sale price. The buyers then challenged this reversal before the Peshawar High Court.
The buyers argued that the plaint did not specify the exact date, time, and place when the plaintiff learned of the sale, and that this omission should have resulted in dismissal. The High Court rejected this argument, relying on Supreme Court precedents which clarified that pleadings only need to state material facts, not detailed evidence like witness names or exact timings. Since the plaintiff had substantially complied with the legal requirements for the two-step demand process, the court upheld the appellate court's decision favoring the pre-emptor.
This case clarifies what level of detail is legally required in pre-emption suits, making it harder for technical objections alone to defeat
