Acting Charge according to NHA Appointment and Promotion Rules 1995

PLJ 2000 Tr.C. (Services) 102 · Islamabad High Court

This case involved multiple employees of the National Highway Authority (NHA) who challenged a seniority list prepared under the NHA's service rules. The employees, represented by several senior lawyers, disputed how seniority was calculated, particularly regarding appointments made on an acting-charge basis and the status of regular versus work-charge employees.

The Federal Service Tribunal examined the legal history behind NHA's employment rules, tracing them back to the earlier National Highways Board Employees Services Rules of 1974, and clarified that even though no law explicitly repealed the 1974 rules, they were effectively superseded once the newer 1995 Rules were enacted, since two sets of rules on the same subject cannot operate simultaneously.

On the substantive issue, the Tribunal ruled that being appointed on an acting-charge basis does not automatically entitle an employee to regular promotion or seniority rights. It also found that seniority is correctly counted from the date of regular appointment, following the principle of seniority-cum-fitness, and that an employee appointed later cannot be made senior to one appointed earlier. Since the appellants were found to be junior to the respondents under the rules, their appeals against the seniority list were dismissed as not legally sustainable.
