Principle of Trichotomy of Powers
PLJ 2000 SC 547 [Appellate Jurisdiction] · Lahore High Court
This Supreme Court judgment arose from appeals challenging decisions of the Lahore High Court, which had struck down the Punjab Undesirable Co-operative Societies (Dissolution) Ordinance, 1992. The Ordinance allowed the Punjab government to dissolve co-operative societies it considered "undesirable," particularly those operating like unregulated financial institutions taking deposits from the public. Several affected co-operative societies had challenged the law, and the High Court agreed it was unconstitutional, finding it violated citizens' fundamental rights, lacked clear guidelines, amounted to a "legislative judgment" condemning specific societies without trial, and breached the constitutional separation of powers (trichotomy) between legislature, executive and judiciary.
The Supreme Court disagreed with most of this reasoning. It held that the Ordinance did provide adequate safeguards, since affected societies could seek redress before a co-operative judge and then through writ petitions in the High Court—satisfying requirements of due process even without a prior hearing. The Court also held that the existence of other laws like the Co-operative Societies Act and Banking Companies Ordinance did not prevent the legislature from enacting this special law, and that the Ordinance did not declare anyone guilty of an offence. Consequently, the Supreme Court set aside the High Court's judgments and upheld the Ordinance's validity, except confirming that one specific section (Section 22) was indeed unconstitutional. This case clarifies limits on separation-of-powers challenges
