Relationship between principal and agent
PLJ 2000 · Lahore High Court
This case involved a dispute over compensation money for land that had been acquired by the government for the Motorway Project. Six landowners had given a general power of attorney to one Asghar Ali, authorizing him to pursue the land acquisition case on their behalf, including receiving and depositing compensation money for case-related purposes. However, Asghar Ali opened a bank account in his own name at a National Bank of Pakistan branch, deposited the entire compensation amount there, and then withdrew the money, leaving the actual landowners with nothing.
The landowners complained to the Wafaqi Mohtasib (federal ombudsman), who investigated and found that the bank, through its branch manager, had actively colluded with Asghar Ali in this fraud. The bank had violated its own rules by allowing a large withdrawal without the required seven-day notice, and had ignored internal warnings from its own inquiry officer and legal counsel that the power of attorney did not actually authorize Asghar Ali to open an account in his own name. The Mohtasib ordered the bank to repay the landowners. The bank challenged this, and its appeal to the President was rejected.
The Lahore High Court upheld the Mohtasib's decision, ruling that the power of attorney never authorized Asghar Ali to receive the money into his personal account, and that the bank bore responsibility for enabling the fraud. The court declined to interfere, noting its constitutional jurisdiction is discretionary and that justice had already been done for the defrauded landowners. The case highlights banks' accountability for verifying
