Protection under copyrights ordinance in Pakistan
PLJ 2000 Karachi 230 · Sindh High Court
This case involved two linked disputes between Dabur India Ltd. (maker of Hajmola digestive candies) and Hilal Confectionery over use of the "Hajmola" trademark and its distinctive candy wrappers. Dabur, which had used and registered Hajmola in India and other countries since the 1970s-80s, argued that even though its mark was not registered in Pakistan, it had acquired a "trans-border reputation" there through spillover advertising, satellite television, imported goods, and travel by Pakistanis abroad. The judgment is significant for clarifying how foreign trademarks without Pakistani registration can still
