Victory of a MBBS Student in a Case
PLJ 1999 Peshawar 57 (DB) · Peshawar High Court
This case is about a student, Raza Hassan, who applied for admission to the first year MBBS program at Khyber Medical College, Peshawar, for the 1997-98 session. He applied under both the regular merit category and the self-finance category before the official deadline, took the required entry test, and passed it. Only the interview stage remained.
However, after the deadline had passed and the entry test results were already out, the government changed the admission rules through a letter from the Health Department, allowing children of doctors who had missed the original deadline to compete for self-finance seats as well. This reduced the number of available seats and resulted in some candidates with lower merit than the petitioner getting admission, while he was left out.
The Peshawar High Court examined whether this late change in policy was valid. It found that the change was not properly made through an official notification, as required when altering rules in the admission prospectus, but was instead communicated through an informal letter. Since the petitioner had already fulfilled all requirements before the deadline, the Court held that he had earned a vested right to be considered fairly.
The Court ruled in his favor, directing that he be admitted to the first year MBBS class, without disturbing the admissions already granted to other students. The case highlights the importance of due process and fairness in changing admission rules after students have already met existing requirements.
