This case involved a citizen who applied to the telephone department for a new connection but never received one, even though he was billed for a number that was never actually installed. Frustrated, he filed a complaint with the Wafaqi Mohtasib (federal ombudsman), who investigated, found the telephone department guilty of maladministration, and ordered it to install the connection free of cost within 30 days. The department neither complied nor challenged this order through the legal channels available to it, such as appealing to the President of Pakistan or approaching the courts. Instead, it simply ignored the ombudsman's direction.
The petitioner then went to the Lahore High Court asking it to enforce the ombudsman's order. The department argued that installing the connection required erecting 14 poles, calling it a policy matter beyond the court's jurisdiction, and suggested the petitioner should have filed a contempt case instead.
The High Court rejected these arguments. It held that public functionaries are legally bound to obey directions of the Wafaqi Mohtasib unless they formally challenge them before the President or the courts. Since the department did neither, its failure to act showed bad faith. The court ordered the telephone department to implement the ombudsman's order in letter and spirit within four months.
This judgment matters because it reinforces that government agencies cannot simply ignore ombudsman rulings; they must either comply or formally contest them through proper legal avenues.
