Case in which defendant is not made party in Appeal
PLJ 1998 Karachi 289 · Sindh High Court
This case involved a dispute over property, where the District Council Tharparkar had filed an appeal against a judgment involving Syed Muhammad Wali and the Government of Sindh. When the appeal reached the District Judge, the Government of Sindh, which had been a defendant in the original suit, was not made a party to the appeal. A preliminary objection was raised before the Sindh High Court arguing that this omission made the entire appeal legally defective and therefore the revision petition arising from it should be dismissed.
The High Court examined Order XLI, Rule 20 of the Civil Procedure Code, which allows an appellate court to add a person as a respondent if that person was party to the original suit and is interested in the outcome of the appeal. The court noted that this rule does not specify any automatic penalty for failing to implead such a person, and that the matter is left to the court's discretion based on whether the omitted party is genuinely necessary and affected by the outcome.
The court found that the Government of Sindh had no real stake in the dispute, had not claimed ownership of the property, had never objected during nearly five years of proceedings, and had not appealed itself. The real contest was between the plaintiff and the other defendant. Since the Government was merely a formal party and not genuinely affected, the court held that its non-joinder did not invalidate the appeal, and the objection was rejected.
This case clarifies that not every missing party automatically defeats an appeal; courts must assess whether that party was truly necessary to the dispute.
