Admiralty Jurisdiction of High Court
PLJ 1998 Karachi 233 [Admiralty Jurisdiction] · Sindh High Court
This case was heard by the Sindh High Court under its admiralty jurisdiction. The plaintiff, Aslo Marines Limited, sued the vessel M.T. Magda and its owners for over Rs. 13 lakh in damages, claiming that cargo shipped on the vessel between Saudi Arabia, Kuwait, and Karachi was short-landed and delivered late, causing financial loss due to price increases in the market.
The key legal issue was whether the plaintiff, who was merely the charterer of the vessel (not the owner, consignee, or assignee of the bill of lading), had the right to bring such a claim under the court's admiralty jurisdiction. This depended on Section 6 of the Admiralty Court Act, 1861, which specifically limits such claims to owners, consignees, or assignees of a bill of lading.
The court found that the plaintiff did not fall into any of these categories, being only a charterer under a charter-party agreement. Relying on precedent and the specific wording of the 1861 Act—which continues to govern admiralty jurisdiction in Pakistan despite later reforms in English law—the judge ruled that charterers have no standing to sue under this provision.
As a result, the suit was dismissed as not maintainable. The case is significant because it clarifies the limits of who can bring cargo damage claims in Pakistani admiralty courts, confirming that charterers, unlike owners or consignees, cannot use this specific legal route for such claims.
