Critereon for determining Benami Transaction

PLJ 1998 Karachi 1 · Sindh High Court

This case involved a husband suing his wife, asking the court to declare that he was the real owner of a house and plot registered in her name, claiming she held it only as a "benamidar" (a nominal owner holding property on behalf of someone else who actually paid for it).

The couple married in 1956. The husband claimed that in 1967-68 he sold an earlier house he owned, used the proceeds plus his savings to buy the disputed plot and build a house on it, but registered it in his wife's name out of mutual trust. He later remarried, and when relations with his wife deteriorated and she refused to let him move back into the house, he sued her for ownership, possession, and related relief in 1989.

The wife denied this, saying she bought the property herself using her own earnings as a teacher and later a bank employee, along with loans she had taken out.

The court explained that in benami cases, the person claiming ownership must prove it, based on factors like who actually paid for the property, who held the original title documents, who possessed the property, and what motive existed for structuring it as benami. The husband failed to produce evidence supporting his claims, while the wife showed she had sufficient income and means to purchase the property herself. The court also found the suit was filed too late, well beyond the six-year limitation period. The suit was dismissed with costs.
