Poor remarks against judiciary can result in contempt of court
PLJ 1998 Cr. C (Quetta) 1119 DB · Lahore High Court (Rawalpindi Bench)
This case is about contempt of court proceedings brought against the Editor-in-Chief of a daily newspaper, Lashkar, after it published a news headline on 28 November 1997 that the court found to be false, scandalous, and damaging to the reputation of judges and the judiciary as a whole. The Chief Justice initially flagged the offending headline, and a single judge of the High Court took up the matter, eventually finding the editor guilty under the Contempt of Courts Act, 1976, and sentencing him to six months' imprisonment plus a fine.
The editor appealed to a larger bench, explaining that he had been away in Rawalpindi when the item was published, that he immediately sacked the Chief News Editor responsible once he learned of it, and that he had tendered an unconditional and sincere apology without contesting the case or hiring a lawyer.
The appellate bench upheld the finding of guilt, agreeing that the publication did amount to contempt. However, considering his genuine remorse and unconditional apology, the court reduced his punishment, ruling that the time he had already spent in custody was enough to satisfy justice. He was ordered released, subject to paying the fine.
The case matters because it shows how courts balance protecting judicial dignity from scandalous reporting with recognizing genuine remorse and apology as grounds for leniency in sentencing.
