Perjury is a heinous offence
PLJ 1998 Cr. C. ( · Peshawar High Court
In this case, the Peshawar High Court dealt with a man named Haji Umar Khan who had originally filed a police report (FIR) accusing certain people of murdering his relative with firearms. The case went to trial, but when Umar Khan was called to testify under oath, he suddenly reversed himself, claiming he had never actually witnessed the murder and had not voluntarily lodged the FIR. He suggested he had been pressured by police and by the complainant's brother to sign a false report.
The trial court did not believe this reversal. It found that Umar Khan had indeed filed the original report of his own accord and signed it correctly, and that his later denial under oath was false. He was convicted of perjury under Section 193 of the Pakistan Penal Code and sentenced to three years of rigorous imprisonment plus a fine of Rs. 10,000.
Umar Khan appealed the conviction, while the deceased's brother separately sought a harsher sentence. The Peshawar High Court reviewed the trial record and upheld the conviction, finding the trial judge's reasoning sound and not arbitrary. The High Court emphasized that lying under oath in court is a serious offense, since it can destroy an innocent person's reputation or freedom by falsely implicating them in a crime. Such conduct, the court said, deserves no leniency.
This case matters because it reinforces that witnesses who contradict their own sworn statements without credible justification can be prosecuted and punished for perjury, protecting the integrity of judicial proceedings.
