Judgment on Rule of Consistency
PLJ 1998 Cr.C. (Lahore) 1278 · Lahore High Court
This case arose from a murder complaint filed by Muhammad Waryam after his son Riaz Ahmad was killed and his daughter injured. Three men, Daim, Aziz alias Ghazi, and Mehmood alias Mooda, were accused. The trial court had granted bail to Mehmood but refused it to Aziz, even though the FIR described both men as having played the same role in the incident. Two applications came before the Lahore High Court: one by the complainant seeking to cancel Mehmood's bail, and another by Aziz seeking bail for himself.
The complainant argued Mehmood's bail should be cancelled because he allegedly misused his freedom to intimidate a witness and commit further crimes, but the court found this claim did not hold up, especially since a related case against him had been withdrawn. On the question of Aziz, the court noted that investigation records showed both accused had been declared innocent by one investigating officer, with a difference of opinion among investigators making this a case fit for further inquiry.
Since the FIR placed both men in identical circumstances, the court held that treating them differently for bail purposes violated the rule of consistency, a principle requiring equal treatment for people in similar situations. The court therefore dismissed the request to cancel Mehmood's bail and granted bail to Aziz as well. This case highlights how courts ensure fairness by treating co-accused facing similar allegations and evidence in the same manner.
