Non Compliance of 265-C shall vitiate Trial
PLJ 1997 FSC 61 · Lahore High Court (Multan Bench)
This case involved a married woman, her alleged lover, and a third person who were convicted by an Additional Sessions Judge in Multan under Pakistan's Offence of Zina (Enforcement of Hudood) Ordinance, 1979. The allegations centered on a woman accused of disguising her identity under a false name to remarry while still legally married to the original complainant, leading to charges of adultery (zina) and related fraud offences. The accused received lengthy prison sentences, whipping, and fines.
On appeal, the defense argued that the trial court had failed to follow a mandatory legal requirement: before trial, the accused should have been given copies of the complaint, witness statements, and other key documents under Section 265-C(2)(d) of the Criminal Procedure Code. This failure meant the accused couldn't properly cross-examine witnesses or prepare their defense. Notably, both the complainant's lawyer and the state prosecutor agreed that this requirement had not been met, and they consented to sending the case back for retrial.
The Lahore High Court (Multan Bench) accepted the appeal, relying on earlier Supreme Court precedent establishing that compliance with Section 265-C is mandatory, not optional - and that failing to follow it invalidates the entire trial. The court set aside the conviction and ordered a fresh trial after the missing documents are properly supplied, directing the lower court to resolve the matter within three months.
This case matters because it reinforces a fundamental fair-trial safeguard: accused persons have a legal right to see the evidence
