Jurisdiction of Rent Controller
PLJ 1996( Karachi) 156 · Sindh High Court
This case concerns a dispute between a landlord, Mrs. Tahira Qureshi, and her tenant, Bashir Ahmad Munir, who was running a motor workshop in rented shops in Karachi. The landlord sought his eviction, mainly on the ground that she genuinely needed the premises for her own use, to expand a boutique business and set up a display centre and tailoring workspace.
The tenant resisted, raising several arguments. He claimed the Rent Controller had no jurisdiction because the landlord had wrongly described him as a "caretaker/trespasser" in her legal notice, implying there was no real landlord-tenant relationship. He also argued her claimed need was not genuine, questioning her occupation and business experience, and said the area was unsuitable for a boutique since it was surrounded by motor workshops.
The Sindh High Court rejected all these objections. It found that the tenant himself had admitted being a tenant in his reply notice, written statement, and cross-examination, so the Rent Controller did have jurisdiction. It held minor inconsistencies in the landlord's evidence about her occupation did not undermine her case, and that everyone is free to pursue a business of their choosing regardless of prior experience. The court also noted evidence that the area actually had many tailoring shops and boutiques, contradicting the tenant's claims.
The appeal was dismissed, upholding the eviction order, reaffirming that genuine personal need of a landlord, once reasonably established, justifies eviction under rent laws.
