249-A can be decided after giving opportunity to complainant

PLJ 1996 Cr. C. (Karachi) 1371 · Sindh High Court

This case involved a dispute over an alleged land sale deal between the appellant and the respondents. The appellant claimed he had entered into agreements to purchase agricultural land and paid large sums of money in cash, totaling over Rs. 28 lakhs, to Respondent No. 1, who was acting on behalf of himself, his mother, and his sister. When the deal allegedly fell through, the appellant filed a criminal complaint. The trial Magistrate, using powers under Section 249-A of the Criminal Procedure Code, acquitted the respondents before completing the full trial, finding the complaint groundless. The appellant challenged this acquittal in the Sindh High Court.

The High Court rejected the appeal. It held that an application under Section 249-A can be decided at any stage of proceedings, not only after all witnesses have testified, so long as both sides are given a hearing and the magistrate records clear reasons. The court found the appellant had been given full opportunity to argue his case, that his supporting documents (receipts) appeared forged or tampered with, that his witnesses gave hearsay or interested testimony, and that he had concealed a related civil suit. The court also noted that long, unexplained delay in filing a criminal complaint weakens its credibility.

This ruling clarifies that magistrates can dismiss weak criminal complaints early, provided fairness is maintained, preventing misuse of criminal courts to pressure parties in what are essentially civil disputes.
