Powers of a Civil Judge in Ex-Parte Suits
PLJ 1992 SC 94 · Lahore High Court
This case involved a contractor who had done repair and construction work for the Punjab government. After a dispute over a stopped payment cheque, he sued the government for "rendition of accounts," asking the court to make the government disclose records showing what was owed to him. Because the government did not appear in court, the trial judge passed an ex-parte preliminary decree in the contractor's favor, appointed an accountant to examine the records, and later issued a final decree awarding him a specific sum based on that report.
The government then appealed to the High Court, which overturned both the preliminary and final decrees, ruling that since the relationship between the parties was contractual rather than fiduciary, the government was never obligated to "render accounts," and the contractor should have simply sued for a specific amount.
The Supreme Court restored the contractor's decree. It held that the trial judge did have jurisdiction to hear the case, and that the government's absence from the original proceedings amounted to waiving its right to object to that jurisdiction. More importantly, since the government never appealed the preliminary decree within the legal time limit (as required under Section 97 of the Civil Procedure Code), it could not later attack that decree indirectly by appealing only the final decree. Allowing this would let parties bypass limitation laws. The case clarifies the limits of a civil judge's authority in ex-parte suits and reinforces that procedural deadlines for challenging decrees must be respected.
