Justice Malik Qayyum's Judgment over Benami Transaction

PLJ 1992 Lahore 302 · Lahore High Court

This case involved a dispute over land that had originally been bought in 1956 by a father in the names of his two minor sons, including the petitioner. Years later, in 1967, the father sold half of that land to another party. The petitioner then sued, asking the court to declare that his father had no right to sell the land because it legally belonged to him, not his father.

Both the trial court and the first appellate court rejected his claim, finding instead that the petitioner was merely a benamidar, meaning his name was used on paper, while his father remained the true and beneficial owner who had actually paid for and controlled the property. The petitioner then challenged this finding before the Lahore High Court.

The High Court upheld the lower courts' decisions and dismissed the petition. It noted that the petitioner, who was a minor at the time of purchase, could not show any independent income or that he had personally paid for the land. His own evidence even contradicted his written claim, since he first said his father bought the land, then claimed his mother had purchased it. The court reaffirmed that Pakistani law does not recognize the English doctrine of advancement, meaning property bought by a father in a child's name is presumed benami unless proven otherwise. Since the petitioner failed to rebut this presumption, his suit was rightly dismissed.
