Constitution Petition is maintainable if petitioner is deprived anyway

PLJ 1991 Lahore 345 · Lahore High Court

This case was about a university teacher, Ihsanullah Bajwa, who was denied an overseas scholarship under the Central Overseas Training Scheme, even though his department head had initially recommended him as the top candidate over a colleague, respondent No. 6. The university later reversed this recommendation and put the colleague forward instead. After an earlier court challenge succeeded on procedural grounds (he had not been given a hearing), the matter was reconsidered by a committee, which again rejected him. He then filed this constitutional petition challenging that decision.

The authorities argued the petition could not be heard because a scholarship is discretionary, not a legal right, and that the petitioner was ineligible since he had already received a scholarship before. The Lahore High Court rejected these objections. It held that a person does not need a strict legal right to approach the court under Article 199; it is enough that he has been deprived of a benefit through a public authority's failure to follow its own rules. The court also found that the official criteria only barred candidates who had received a scholarship within the last three years, and since more than three years had passed since the petitioner's earlier scholarship, he was wrongly excluded. Since his merit score was higher than the other candidate's, the court ruled the decision was arbitrary and violated the constitutional guarantees of equal treatment, and accepted the petition.
