Professional Misconduct Judgment
PLJ 1990 Tr.C (Misconduct) 101 · Not specified
This case was heard by the Tribunal of the Pakistan Bar Council and dealt with a professional misconduct complaint filed by Mst. Razia Begum against an advocate, Sardar Muhammad Ishaq.
The complainant alleged that the advocate had charged large sums of money from her family for arranging her son's marriage at his own residence, for filing a restitution of conjugal rights case, and for defending her son in a criminal case under the Hudood Ordinance. She also claimed he secretly took money from the opposing party and gave bad advice that harmed her son's interests, eventually leading to a divorce.
The Tribunal examined the evidence and found that most allegations, including claims that the advocate was bribed by the opposing side or deliberately mishandled the case, were not proven. However, it did find two things established: first, that the advocate had allowed his own home to be used for the marriage and had charged a fee of Rs. 10,000 for this, which was improper; and second, that he had acted as defense counsel in the Hudood case despite being himself a prosecution witness in that same case, a clear conflict of interest he should have avoided from the start.
Based on these findings, the Tribunal reprimanded the advocate, ordered him to pay Rs. 12,000 in costs to the complainant (including reimbursement of the improperly charged fee), and directed that the reprimand be recorded in the official rolls of advocates. The case highlights the importance of lawyers avoiding conflicts of interest and acting with transparency regarding fees.
