What is the concept of bonded labor?

PLJ 1990 SC 216 · Supreme Court of Pakistan

This Supreme Court of Pakistan judgment deals with the problem of bonded labour at brick kilns, where workers became trapped in cycles of debt owed to kiln owners. The case reached the Court through a telegram alleging that labourers were being held against their will and forced to work off loans (peshgis) advanced by owners, sometimes through intermediaries called Jamadars/Jamadarnis who controlled payments on workers' behalf.

The Court ruled that the old peshgi system, where owners gave large advances that trapped workers in debt, must end going forward. Only small advances (not exceeding seven days' wages) could be given under fair, agreed terms. The Jamadar/Jamadarni middleman system was abolished entirely, requiring direct dealings between owners and workers. Past unpaid loans remained legally recoverable, but only through courts and legal process, never through coercion or police force. Smaller emergency loans given for events like weddings or funerals were to be treated as forgiven if workers voluntarily returned to work. Workers were given freedom to leave or change employers, with protection from forced retention. The Court also clarified its own broad powers under Article 184(3) of the Constitution to issue whatever orders are necessary to enforce fundamental rights, including acting on information like telegrams.

This case matters because it addressed exploitative labour practices affecting vulnerable workers, using constitutional fundamental rights protections to curb forced labour while balancing legitimate debt recovery through lawful means rather than coercion.
