Conflicting Judgments on Section 4 MFLO

PLJ 1990 SC 204 · Lahore High Court (Multan Bench)

This case is about a dispute over inheritance under Islamic family law in Pakistan, specifically how to calculate the share of a granddaughter whose mother died before the grandmother (the person whose estate is being inherited).

The family involved was: Mst. Daulan (grandmother), her daughter Mst. Lalan (who died before her mother), and Mst. Lalan's daughter Mst. Manzooran. Since Mst. Lalan died before Mst. Daulan, Section 4 of the Muslim Family Laws Ordinance, 1961 treats her as if she were still alive when the inheritance opened, so she would notionally receive her share (one-third of the estate).

The dispute was over how much of that one-third share should then pass to her daughter, Mst. Manzooran. The petitioner (another family member) argued that Manzooran should only get half of her mother's notional share (one-sixth), with the rest going to other relatives, based on a Lahore High Court ruling. The lower courts, however, had awarded Manzooran the entire one-third share, following a Peshawar High Court ruling that said the full notional share passes to the deceased daughter's children.

Since the Lahore High Court and Peshawar High Court had given conflicting interpretations of Section 4, the Supreme Court decided the matter needed a final, authoritative ruling. It granted leave to appeal so this legal question could be settled definitively, while allowing partial interim relief to the petitioner pending the final decision.
