PLJ 1990 Lahore 572 · Lahore High Court
This case concerns a legal dispute about malicious prosecution and whether victims can claim damages when a false police report, not an actual court case, causes them harm.
In 1961, a man named Alamgir filed a false police report accusing Syed Ghayyur Hussain Shah, Muhammad Shafique, and another person of abducting someone as part of a murder conspiracy. Police investigated and found the allegations baseless, and the case was eventually cancelled by a magistrate. The accused men then sued for damages, claiming the false report damaged their reputations and caused them financial and emotional harm. A trial court awarded them damages, but on appeal, this decision was overturned on the technical ground that since the matter never actually went to a court trial (it was resolved at the police investigation stage), a claim for malicious prosecution could not succeed.
The Lahore High Court disagreed. It ruled that the right to sue for malicious prosecution does not depend on whether a formal court case was filed—being falsely implicated in a police investigation is enough, and may even be a stronger basis for a claim. The Court held that anyone who proves malicious action without reasonable cause, which ends in their favor and causes real damage to person, property, or reputation, deserves compensation—whether the proceedings were in a police station or a courtroom.
The Court also ruled that such claims survive the death of the accused person, allowing their heirs to claim damages, departing from older English common law doctrine. This judgment is significant because it expanded protections against false accusations and reinforced constitutional guarantees (Articles
