Judgment under Order 17 Rule 3 of CPC
PLJ 1990 Lahore 497 (DB) · Lahore High Court
This case involved a property partition dispute among the legal heirs of the late Sher Mohammad Dar in Lahore. The plaintiffs, his granddaughters, sought a one-third share of family property that their deceased father would have inherited. During trial, after several adjournments, neither the plaintiffs nor their lawyer appeared on the scheduled hearing date to present evidence. As a result, the trial court closed their evidence and dismissed the entire suit for lack of proof, without specifying which procedural rule justified this harsh step.
The plaintiffs appealed, arguing that the dismissal was wrongly made under a rule that didn't apply to their situation, and that the trial court had acted too harshly given the circumstances, including confusion over whether they and their witnesses were actually present but simply not called into the courtroom.
The Lahore High Court examined two possible legal provisions: Order XVII Rule 3, which allows a court to decide a case on existing evidence when a party fails to do something it was specifically given time to do, and Order XVII Rule 2, which deals with simple non-appearance. The court ruled that Rule 3 did not apply here because the strict conditions for its use were not met. Instead, this was essentially a case of default of appearance, properly falling under Rule 2. Since dismissal for mere non-appearance should allow the losing party a chance to apply for restoration, the court set aside the dismissal and ordered the suit restored for proper hearing. This clarifies when courts can decide cases outright versus allowing parties a second chance.
