Constructed building not to be demolished in case of contract
PLJ 1987 Lahore 596 · Lahore High Court
This case involved a dispute between a contractor, Kartar Masih, and the Municipal Committee of Okara. Under a contract, the petitioner had been given the job of collecting and disposing of dead animal carcasses within the committee's limits for a three-year period. He built a covered structure, spending over Rs. 25,000, to carry out this work, and there was also a resolution suggesting his contract would be extended for another three years at a higher rate.
While a formal lawsuit over his rights was still pending, the petitioner sought a temporary injunction to stop the Municipal Committee from interfering with his work. The trial court granted this interim relief, but the Municipal Committee appealed, and the District Judge overturned it, reasoning that a breach of contract only entitles a party to sue for damages, not for an injunction.
The Lahore High Court disagreed with the appellate court's decision and restored the trial court's injunction. It held that the petitioner had a strong, arguable case because he had invested significant money in constructing the building under permission from the committee, and losing the contract would cause him irreparable financial loss. The court found the balance of convenience favored the petitioner and that the appellate court had failed to properly consider these facts.
This ruling illustrates that courts may protect a party's investment and ongoing business interests through temporary injunctions when significant money has been spent in reliance on a contract, even while the main legal dispute remains unresolved.
