Nafeesa Rehman V. The Election Tribunal Balochistan, Quetta and 2 others,
PLD 2025 Balochistan 9 · Balochistan High Court
This case concerns a woman who tried to contest for a reserved seat for women in the 2024 general elections but missed the deadline for filing her nomination papers.
The Election Commission of Pakistan had set 24 December 2023 as the cut-off date for submitting nomination papers. The petitioner, Nafeesa Rehman, filed her application six days late, on 30 December 2023, asking the Returning Officer for permission to submit her papers anyway. Her request was rejected. She then challenged this rejection through several rounds of litigation, including two earlier constitutional petitions and an appeal to the Election Tribunal, all of which went against her. She finally approached the Balochistan High Court, arguing she had been denied a fair opportunity and that the failure was due to the Returning Officer not properly displaying the required priority list, not her own fault.
The High Court dismissed her petition. It held that Section 104 of the Elections Act, 2017 lays down a strict procedure and timeline for filing nomination papers for reserved seats, and this must be followed exactly as prescribed. Since she had missed the deadline, her later application could not be entertained. The Court also emphasized that election processes are time-bound and, once started, cannot be interrupted by courts at intermediate stages; complaints about the process must instead go through the proper tribunal at the right time. This case reinforces that strict compliance with election deadlines is essential and courts will not relax them for individual candidates.
