PLD 2025 Balochistan 28 · Balochistan High Court
This case is about a money dispute over cheques between two individuals in Quetta. The respondent claimed he had given Rs. 80 lac to the appellant, who allegedly repaid part of it and issued several cheques for the remaining amount. When these cheques were dishonored, the respondent filed a summary suit for recovery of over Rs. 77 lac, and the trial court decreed the full amount in his favor.
On appeal, the Balochistan High Court examined the evidence closely. It found that out of nine cheques claimed, only two (worth Rs. 5 lac each, totaling Rs. 10 lac) had actually been presented to the bank and dishonored, with proper evidence including bank witness testimony. The remaining seven cheques were never shown to have been presented to the bank at all—they were simply produced by the plaintiff himself during his court statement.
The court explained that under the Negotiable Instruments Act, 1881, presenting a cheque to the bank is a mandatory legal requirement before a person can sue on it. Without presentment, no right to recover money arises, and such a suit cannot be maintained under the summary procedure used here.
As a result, the High Court set aside the decree regarding the seven cheques and dismissed that part of the suit, while upholding the decree for the two properly proven cheques (Rs. 10 lac). The appeal was thus partly allowed, reinforcing that mere production of a cheque in court is not enough—proper presentment to the bank is essential to claim payment.
