PLD 2025 Balochistan 118 · Balochistan High Court

This case arose from a property dispute in which the petitioners had filed a civil suit seeking declaration of ownership, possession, and a permanent injunction over disputed land. During the trial, after the petitioners had already presented four witnesses, they sought to introduce additional documentary evidence, specifically a map of the disputed property, through a representative of the revenue authority. They filed this request under Order XIII, Rules 1 and 2 of the Civil Procedure Code. The trial court rejected this application, apparently because it came late in the proceedings.

The petitioners challenged this rejection before the Balochistan High Court. The High Court ruled in their favor, holding that a mere delay in filing an application to produce documents is not, by itself, sufficient reason to refuse it. The law allows courts to admit such evidence at any stage if there is a good cause and if the authenticity of the documents is not genuinely in doubt. Since the document in question was a public record held by the revenue department, there was little risk of tampering or manipulation, and the opposing side would still get a chance to question it during cross-examination.

The Court emphasized that procedural rules exist to serve justice, not to create technical obstacles, and that cases should be decided on their merits. As a result, the High Court set aside the trial court's order and allowed the petitioners to produce the document. This case reinforces that courts should prioritize fair, complete fact-finding over rigid procedural timing.
