Deputy Commissioner/Collector, Quetta and others V. Habib-Ur-Rehman and others,
PLD 2024 Balochistan 87 · Balochistan High Court
This case is about how much compensation the government must pay when it forcibly acquires private land for a public project. The Deputy Commissioner of Quetta acquired land from several owners to widen Joint Road from Dukani Baba Chowk to Chaman Phattak. The government's award fixed compensation at Rs.700 to Rs.800 per square foot. The landowners were unhappy and challenged this before a Referee Court (District and Sessions Judges), which raised the compensation significantly, up to Rs.7000 per square foot for land and Rs.200 per square foot for construction, plus additional costs. The Deputy Commissioner and other government officials then appealed to the Balochistan High Court, arguing the lower courts relied only on witnesses' verbal statements without proper documentary proof of market value.
The High Court disagreed. It explained that under Section 23 of the Land Acquisition Act, 1894, compensation must reflect the true market value of the land at the time of acquisition, considering factors like nearby land sales, the property's development potential, and past transactions. Since the land was in a busy urban part of Quetta and similar nearby land had earlier fetched much higher prices in a comparable acquisition, and since the landowners had presented documentary evidence that the government failed to rebut, the court upheld the Referee Court's decision. The appeals were dismissed.
This case matters because it reinforces that citizens whose land is taken for public projects are entitled to fair, evidence-based compensation reflecting real market value, not arbitrary government rates.
