Masooma and another V. Federal Government through Ministry of Interior Pak Secretariat and another,
PLD 2024 Balochistan 33 · Balochistan High Court
This case concerns two women whose ancestors migrated from Afghanistan to Pakistan, and who themselves were born in Pakistan and later married Pakistani citizens. They applied for Computerized National Identity Cards (CNICs) after meeting the required conditions, but their applications were rejected by NADRA. They challenged this refusal before the Balochistan High Court, arguing they were entitled to CNICs as citizens.
The court examined the Pakistan Citizenship Act, 1951, particularly the provisions on married women (Section 10) and certificates of domicile (Section 17). It found that under the law, a foreign woman married to a Pakistani citizen can be registered as a Pakistani citizen, but only after obtaining a Certificate of Domicile from the Federal Government and taking an oath of allegiance. The court noted that this special route is available only to female foreign nationals, not males. Since the petitioners had not obtained such domicile certificates, NADRA lacked the legal power to issue them CNICs, even though the women appeared otherwise entitled to citizenship by birth and marriage.
Recognizing the hardship caused by their lack of identity documents, the court did not dismiss the petitions outright. Instead, it directed the petitioners to apply to the Federal Government for Certificates of Domicile through the proper process, after which their citizenship and CNIC status could be resolved. The case highlights procedural requirements foreign-born spouses must satisfy to gain recognition as Pakistani citizens.
