PLD 2024 Balochistan 154 · Balochistan High Court
This case from the Balochistan High Court dealt with a murder trial (FIR under sections 302, 337-ADF, 504, 506 and 34 PPC). During the trial, an eyewitness (PW-4) testified but only named one accused as responsible, even though in his earlier police statement he had implicated two accused persons. The complainant's lawyer and the public prosecutor asked the trial court to declare this witness "hostile" so they could cross-examine him, but the trial court refused. The petitioner challenged that refusal before the High Court.
The High Court upheld the trial court's decision. It explained the important legal difference between a "hostile" witness and an "unfavourable" witness. A hostile witness deliberately lies, changes his story, or shows bias against the party who called him. An unfavourable witness simply gives testimony that doesn't help the prosecution's case, without any deceit or hidden motive. The court found that this witness had consistently supported the main story of the incident but had genuinely not implicated the other two accused - there was no evidence he was lying or suppressing truth. Since declaring someone "hostile" is a discretionary power courts must use cautiously, and no grounds for hostility were shown here, the High Court dismissed the petition.
This case matters because it clarifies that simply giving testimony unfavourable to one's own side is not enough to brand a witness "hostile" - actual deceit, inconsistency, or bias must be shown first.
