Khrum Shezad Zafar and 2 others V. Razia Begum and 2 others,

PLD 2024 Balochistan 101 · Balochistan High Court

This case involved a woman, Razia Begum, who filed a lawsuit seeking two things: cancellation of a gift mutation through which she had transferred property to her nephews, and restoration of her possession over two rooms she claimed to have built on that property, from which she said she was forcibly and unlawfully dispossessed. The defendants (her nephews) asked the trial court to reject the entire plaint, arguing it disclosed no valid cause of action since the gift and mutation were admitted facts. The trial court agreed and rejected the plaint outright. On appeal, the District Judge partly disagreed, ruling that while the cancellation claim might be weak, the second claim about forcible dispossession from the rooms deserved to be heard on evidence, and sent that part of the case back for trial.

The High Court upheld the appellate court's decision. It held that when deciding whether to reject a plaint, courts must look only at the plaint's averments, and each case must be judged on its own facts. Since the plaintiff's claim about forcible dispossession from the rooms raised a genuine factual dispute requiring evidence, that portion of the suit could not be dismissed at the outset. Importantly, the court ruled that a plaint cannot be partially rejected—if one part of a suit raises a valid triable issue, the whole application for rejection must fail on that count. The revision petition was dismissed, allowing the dispossession claim to proceed to trial.
