PLD 2023 Balochistan 98 · Balochistan High Court

This case involves a boundary dispute between two neighbouring landowners in Hub, Balochistan, whose properties were affected by the construction of a government bypass road. Each side accused the other of encroaching on their land and filed separate civil suits seeking declarations that the other party was a trespasser, along with directions for the government to survey and demarcate the disputed property. The trial court combined both suits but then returned the plaints, ruling that it had no jurisdiction to hear the matter because such disputes fall under the Balochistan Land Revenue Act, which assigns demarcation issues to Revenue Authorities rather than civil courts.

The appellant challenged this before the Balochistan High Court. The High Court upheld the trial court's decision. It explained that neither party disputed actual ownership as recorded in revenue records; the real issue was about where the boundary line fell after road construction, which is fundamentally a demarcation question. Under the law, civil courts cannot decide demarcation disputes unless the Revenue Authorities have already carried out an official demarcation. Since no such demarcation had occurred, and neither party had approached the Revenue Officer first, the proper venue was the revenue system, not the civil court. The court also clarified that while courts can declare pre-existing rights, they cannot create new rights, and demarcation is not something a civil court can order from scratch.

The appeal was dismissed. This ruling reinforces the principle that boundary and encroachment disputes over agricultural land must first go through revenue authorities, with civil courts stepping in only after demarcation
