Muhammad Azam Khan Swati V. Inspector-General of Police, Balochistan and 2 others,

PLD 2023 Balochistan 85 · Balochistan High Court

This case involved Senator Muhammad Azam Khan Swati, who faced five separate FIRs (police cases) registered in different districts of Balochistan (Zhob, Khuzdar, Lasbella, Gwadar, and Quetta), all arising from the same alleged incident: tweets he posted criticizing state institutions and senior officials, including the Army Chief. The charges included sedition, incitement, defamation, criminal intimidation, and offences under the electronic crimes law. Notably, another case on the same matter was already registered with the FIA in Islamabad.

Swati asked the Balochistan High Court to quash all these FIRs, arguing it was unfair and legally wrong to prosecute him multiple times, in multiple cities, for one and the same act.

The High Court agreed. It held that registering several FIRs across different jurisdictions for the same incident, under the same legal provisions and against the same person, violated constitutional guarantees against double jeopardy (Articles 4 and 13) as well as provisions of the Criminal Procedure Code and General Clauses Act. The law intends a single trial for a single offence, not parallel prosecutions in different courts. Relying on Supreme Court precedent, the judge ruled that pursuing multiple simultaneous cases amounted to harassment and misuse of legal process.

The court therefore quashed all the FIRs and ordered Swati's release. The judgment reinforces the principle that a person cannot be tried repeatedly for the same conduct merely by lodging cases in different locations.
