Sardar Muhammad V. Government of Balochistan through Secretary Home and Tribal Affairs Department, Quetta and 5 others,

PLD 2023 Balochistan 27 · Balochistan High Court

This case is about a man, Sardar Muhammad, who complained to the Balochistan High Court that police were harassing him, raiding his house without warrants, and pressuring him to pay off a debt that was not his own. The alleged debt had actually been taken by his brother, whom the family had publicly disowned, from a private lender (respondent No.6). Instead of taking action against the lender, police repeatedly summoned and pressured the petitioner to repay the money.

The court noted that private money lending is itself illegal under the Balochistan Prohibition of Private Money Lending Act, 2014, and that the police, through their Complaint Redressal Cell, had wrongly used their authority to force repayment on behalf of the lender rather than investigating him for the illegal lending. The judges held that police had no jurisdiction to act as debt collectors and that such financial disputes must be resolved by a proper court after evidence is examined, not through police pressure.

The court also made broader observations about the separation of powers, stressing that only constitutionally recognized courts and tribunals can exercise judicial functions, and that bodies like police complaint cells cannot assume that role. It ruled in favor of the petitioner, ordering the police to stop interfering in the private dispute. The judgment matters because it reinforces limits on police power and protects citizens from being misused as pressure tools in private financial disagreements.
