Saadat Khan V. Ali Sher and 2 others,

PLD 2023 Balochistan 18 · Balochistan High Court

This case explains the legal doctrine of res judicata, meaning that once a court has finally decided a dispute between parties, the same dispute cannot be litigated again. The petitioner, Saadat Khan, had filed an earlier civil suit claiming rights over certain property. He then filed a fresh suit over the same property, seeking cancellation of an agreement and a no-objection certificate, and asking the court to enforce a different, earlier agreement in his favor. The defendants objected, arguing that this new suit was barred because the same property, the same parties, and essentially the same cause of action had already been the subject of previous litigation.

Both the trial court and the appellate court agreed, rejecting the plaint under Order VII, Rule 11 of the Civil Procedure Code, read with Section 11 (the res judicata provision). Saadat Khan then challenged these decisions through a civil revision petition before the Balochistan High Court.

The High Court upheld the lower courts' decisions, explaining in detail the purpose of res judicata: to prevent repeated litigation over matters already decided, protect parties from harassment, and ensure finality of judgments. It also discussed "constructive res judicata," meaning that even issues which could have been raised earlier but were not are treated as decided. Finding that the property, parties, and cause of action were identical to the earlier suit, the court dismissed the revision petition, ruling that the new suit was legally barred and that the petitioner was also stopped by his own conduct from reopening the matter.
