PLD 2023 Balochistan 108 · Balochistan High Court

This case involved a woman and her two daughters seeking release of money from a bank account belonging to their husband and father, Abdul Ghaffar, who had gone missing in 2009 after leaving home and never returning, despite an FIR and complaints to the Commission for Enforced Disappearance. The bank refused to release the funds, insisting that his death first be legally confirmed and that a succession certificate be obtained from a court.

The Balochistan High Court examined whether a missing person can be declared dead by a court, and whether a succession certificate was mandatory before releasing funds. The court held that life cannot be ended by legal declaration just as it is not created by law, so a missing person cannot simply be declared dead. It distinguished between natural death and civil death, noting Islamic law treats a missing person as alive until 90 years from birth. However, relying on Section 124 of the Contract Act on indemnity, the court ruled that the wife could obtain the funds by furnishing an affidavit or personal indemnity bond, protecting the bank if the missing person later reappeared. The petition was allowed, and the bank was directed to release the money to the wife upon such indemnity, without requiring proof of death or a succession certificate.

This judgment matters because it provides a practical, humane solution allowing families of missing persons to access frozen funds for survival, without forcing an artificial legal declaration of death.
