PLD 2022 Balochistan 81 · Balochistan High Court
This case involved two civil disputes over ownership and possession of the same piece of land in Quetta, filed by the same plaintiff against different sets of defendants. He sought court declarations confirming his ownership and orders stopping others from interfering with the property. During the trial, a local commissioner (a court-appointed person, here an advocate) was sent to inspect the site and measure the land, with the consent of both parties. Based largely on that commissioner's report, the trial court dismissed both suits, and the appellate court upheld those dismissals.
The plaintiff challenged this in the Balochistan High Court, arguing that the lower courts wrongly treated the commissioner's report as if it were a binding arbitration decision, while ignoring the actual evidence presented by the parties. He also complained that his pending applications to amend or withdraw parts of his case had never been decided before judgment.
The High Court agreed with him. It clarified that a local commissioner appointed under the Civil Procedure Code is meant only to clarify specific factual matters, like measuring land, not to act as an arbitrator whose findings replace the court's own evaluation of evidence. Consent to appoint a commissioner does not mean the parties made him the final decision-maker. The Court also held that pending applications must be decided before the main case, and each legal issue must be addressed separately. As a result, the High Court accepted the revision petitions, meaning the lower courts' decisions were set aside for reconsideration in light of proper procedure.
