This case is about whether a defamation lawsuit could proceed after the plaintiff had already tried and abandoned earlier attempts to sue over the same issue. Kazim Ali sued Ishaq Ali for defamation and damages of Rs. 10 million, claiming a 2011 newspaper publication had harmed his reputation. The trial court dismissed his suit at the outset, under a procedural rule allowing rejection of a plaint without a full trial, and Kazim Ali appealed.
The High Court upheld the dismissal. It found that Kazim Ali had previously filed two earlier suits over the same defamatory publication and the same facts - one of which he withdrew without court permission to refile, and another which was already rejected by a different court. He concealed these facts from the trial court in his new suit, approaching it with "unclean hands." Under civil procedure rules, once a suit is withdrawn without permission to file afresh, the plaintiff cannot bring a new suit on the same cause of action. The court also noted that the Defamation Ordinance, 2002, sets its own strict time limits for filing such claims, requiring notice within two months of learning of the defamatory material - here, the legal notice was sent eight years late, far beyond that limit.
