Dr. Ilyas and another V. Government of Balochistan through Chief Secretary and others ,

PLD 2022 Balochistan 58 · Balochistan High Court

Dr. Ilyas, a professor, challenged a provision of the Bolan University of Medical and Health Sciences Act, 2017, which allowed the Governor of Balochistan, acting as Chancellor of the university, to appoint the Vice-Chancellor without needing the advice of the Provincial Government, Cabinet, or Chief Minister.

The Balochistan High Court held that this arrangement was unconstitutional. Under Article 105 of the Constitution, the Governor of a province is generally bound to act on the advice of the Chief Minister, except in specific situations where the Constitution expressly allows independent discretion. The court rejected the argument that a Governor acting under a special statute (rather than directly under the Constitution) could bypass this requirement, saying no such distinction exists in law. Since the Governor has no powers beyond what the Constitution grants, a law cannot give him unchecked personal authority to appoint university heads.

The court also explained the background of the 18th Constitutional Amendment, which shifted education mostly to provincial control, while matters of standards in higher education remained under joint federal-provincial jurisdiction.

As a result, the court struck down the relevant sections (15(1) and 15(2)) of the university law, declaring them void for violating Article 105. This case matters because it reinforces the principle of constitutional government—Governors must act on ministerial advice—and limits the ability of provincial laws to hand unchecked personal power to a Governor in university appointments.
