Bahadur Khan V. Karim Gul and 4 others,

PLD 2022 Balochistan 51 · Balochistan High Court

This case concerns a land dispute from Quetta, Balochistan. A buyer (respondent No.1) sued, claiming he had purchased a plot of land partly from Bahadur Khan (the petitioner) through an attorney (respondent No.2), who he said held power of attorney to sell Khan's share. The buyer claimed he paid most of the price and would pay the rest at the time of mutation (official transfer of ownership records). Both the trial court and the first appellate court ruled in the buyer's favor and ordered the land transferred to him.

Bahadur Khan challenged this in the Balochistan High Court, arguing that the buyer never actually produced the written sale agreement or the power of attorney he relied on, and that the case was instead decided based on oral testimony that went beyond what had been stated in the original pleadings.

The High Court agreed with Khan. It held that under the Qanun-e-Shahadat (Pakistan's law of evidence), agreements to sell immovable property and powers of attorney involving property rights must be properly attested by witnesses and proved through those witnesses in court. Since neither document was produced or proved, and the buyer's own testimony contradicted his written claims, the lower courts' decisions were legally flawed. The High Court set aside the earlier judgments and dismissed the suit, emphasizing that such important property documents cannot simply be assumed or proved through inconsistent oral statements.
