PLD 2022 Balochistan 43 · Balochistan High Court

This case involved two lawsuits arising from the same land dispute. One party (the petitioner) sued for a declaration, cancellation of mutation entries, and a permanent injunction, while the other party had already filed a separate suit over the same matter. The trial court combined both cases, dismissed the petitioner's suit, and decreed in favor of the other side. The petitioner appealed, but the appellate court dismissed the appeal for non-prosecution under a rule (Order XVII, Rule 3 of the Civil Procedure Code) that applies to trial-level suits, not appeals.

The High Court found this was a legal error. It explained that Order XVII, Rule 3 uses the word "suit" and only governs trial proceedings, not appeals. Appeals can only be dismissed for a party's absence under a different rule, and only on a date actually fixed for hearing. Here, the date the appeal was dismissed was not a proper hearing date, and worse, the record showed that notices to the appellant had never been properly served—they came back marked "unserved" or "refused," which cannot be treated as valid service.

The court held that people's legal rights should not be lost due to procedural technicalities or administrative errors by the court itself. It set aside the appellate court's dismissal order and sent the case back for a proper hearing on the merits. This decision reinforces that appellate courts must follow the correct procedural rules and ensure proper notice before dismissing an appeal.
