Church Missionary Trust Association through Authorized representative V. Federation of Pakistan through Ministry of Religious Affairs, Islamabad and others,

PLD 2022 Balochistan 36 · Balochistan High Court

This case concerns disputes over church-owned communal properties belonging to the Christian community in Balochistan. The Deputy Commissioner of Quetta had issued an order restraining revenue authorities from issuing property documents to anyone except one specifically authorized individual, in an attempt to stop fraudulent groups and land grabbers from falsely claiming ownership of Christian community properties using fake powers of attorney. The Church Missionary Trust Association challenged this order before the Balochistan High Court.

The High Court disposed of the petition by laying down clear rules: communal property meant for a minority community's collective use cannot be bought, sold, or transferred by anyone; any minority community member can obtain certified copies of revenue records regarding such property, but cannot purchase it; the Deputy Commissioner has no authority to approve transfers of communal minority property; and even the petitioner organization or church diocese representatives themselves cannot sell or transfer such properties. The Court declared the Deputy Commissioner's original letter unlawful and void, and directed all judges in the province to decide pending property disputes involving minority communal land according to the Balochistan Protection of Communal Property of Minorities Act, 2018.

The judgment also discussed constitutional protections for religious minorities, Islamic legal traditions of religious tolerance, and international human rights obligations. It matters because it strengthens legal safeguards against land mafias exploiting vulnerable minority communities and clarifies that communal properties are protected from private sale altogether.
