PLD 2022 Balochistan 30 · Balochistan High Court

This case involved a property dispute in Quetta. The petitioner (plaintiff) filed a lawsuit seeking declaration of rights, enforcement of a property distribution agreement dated July 2013, partition, possession, and other relief against the respondents. He claimed the agreement entitled him to a share of property that had allegedly been distributed among the parties. Both the trial court and the appellate court dismissed his case, finding he failed to properly prove the agreement.

The Balochistan High Court, hearing his revision petition, upheld these decisions. The court explained that under the law of evidence (Qanun-e-Shahadat Order), any document requiring attestation—like the agreement in question—must be proved by calling at least two witnesses who actually witnessed its signing. The plaintiff's witness had not witnessed the agreement being signed and gave contradictory testimony, so this requirement was not met. Meanwhile, the other side produced a registered sale deed for the property, and registered documents carry more legal weight than oral testimony; oral evidence alone cannot disprove a registered document. Since the plaintiff could not produce any competing document to challenge the sale deed, his case failed.

The court also noted that its revisional powers are limited—it can only step in for major legal errors or clear misreading of evidence, not to re-decide factual findings that lower courts have already agreed upon. Finding no such error here, it dismissed the petition, leaving the earlier rulings intact.
