Taj Muhammad V. Noor Ud Din and another,
PLD 2021 Balochistan 97 · Balochistan High Court
This case is about a property dispute in Quetta. Taj Muhammad claimed he was the rightful owner of a piece of land, saying a mutation entry (record of property transfer) had been fraudulently created without his knowledge or signature. He sued to cancel that mutation, regain possession, and secure declarations confirming his ownership. Both the trial court and the first appellate court rejected his suit, so he brought the matter to the Balochistan High Court.
The key legal issue was about how expert evidence, specifically a handwriting and fingerprint analysis report, had been used in the case. The report suggested his signature on the disputed mutation was not genuine, though the thumb impression matched his. However, the expert who prepared this report was never called to testify in court or be cross-examined; the trial court simply placed the report on record as evidence.
The High Court ruled this was improper. It held that expert opinions are only legally relevant if the expert is produced in court to explain and defend the findings, allowing the other party to cross-examine them. Simply filing or 'exhibiting' a report without the expert's testimony does not make it valid evidence, even if both sides initially seemed to accept it. The court also clarified that any document, not just expert reports, must be proven through a witness, not just placed on file.
This case matters because it reinforces basic fairness in legal proceedings, ensuring that evidence, especially technical expert findings, is properly tested and not accepted blindly.
