PLD 2021 Balochistan 94 · Balochistan High Court

This case involved a double murder arising from a tribal dispute in Harnai, Balochistan. According to the FIR, two armed men on a motorcycle opened fire on a vehicle returning from a tribal settlement meeting, killing two passengers while two others escaped. After investigation and trial proceedings, the complainant asked the trial court to transfer the case to an Anti-Terrorism Court, arguing the attack qualified as terrorism. The Additional Sessions Judge rejected this request, and the complainant's relative (the petitioner) challenged that rejection before the Balochistan High Court.

The High Court upheld the lower court's decision and dismissed the petition. It explained that not every brutal or deadly crime counts as terrorism under the law. Courts must look at the FIR, witness statements, and other evidence to judge the true purpose behind an act. Terrorism requires that the action be designed to achieve specific objectives such as spreading fear, intimidating the public, or advancing ideological, religious, or political aims—not simply causing harm to specific victims. Relying on a recent Supreme Court ruling, the Court clarified that even grave or horrifying crimes do not qualify as terrorism if they stem from personal enmity or private disputes, as appeared to be the case here given the tribal settlement background.

This judgment matters because it reinforces an important legal distinction: ordinary murders arising from personal feuds should be tried in regular criminal courts, not anti-terrorism courts, unless there is clear evidence of intent to terrorize society at
