Messrs Abaseen ORE through Azmat Khan V. Director General (Licensing Authority) Mines and Minerals, Balochistan and another,

PLD 2021 Balochistan 9 · Balochistan High Court

This case involved a mining contractor, Abaseen ORE, whose contract for collecting royalty on minor minerals in District Pishin and Killa Abdullah had been terminated by the Mines and Minerals authorities in Balochistan. The contractor had earlier filed a constitutional petition challenging the termination, but the Balochistan High Court dismissed it, finding that the matter involved disputed factual questions (including allegations of foul play) that could not be resolved through constitutional jurisdiction without detailed evidence and investigation.

Unsatisfied with that outcome, the petitioner filed this review application, arguing that the court had overlooked certain constitutional provisions, a section of the General Clauses Act, and some of his counsel's arguments.

The High Court rejected the review application. It explained that review is a very limited remedy, available only when there is an obvious, self-evident error on the face of the record, or when new and important evidence has come to light that could not have been produced earlier. It is not meant to allow re-arguing a case or getting a second opinion on points already decided, even if the original decision might have been wrong. Since the court found that it had already carefully considered all the petitioner's arguments, there was no manifest error justifying review, and the application was dismissed.

This case is useful for understanding how limited the scope of judicial review is in Pakistani law, reinforcing that courts will not reopen settled matters absent a clear, obvious mistake.
