PLD 2021 Balochistan 79 · Balochistan High Court
This case involves a property dispute over a house allotted on a government plot in Dera Allah Yar, Balochistan. The original plaintiff had sued the defendant seeking a declaration that he was the lawful allottee of the house and an order directing the defendant to vacate and hand over possession, claiming the defendant had illegally occupied it.
The trial court partly decreed the case, ruling that the plaintiff was the lawful allottee but finding that since both parties were living in separate portions of the property, the defendant's occupation could not be called illegal, so possession was not ordered to be handed over. The plaintiff appealed, and the District Judge overturned this, declaring the plaintiff the legal allottee and ordering the defendant to vacate and hand over full possession. The defendant then challenged that appellate decision before the Balochistan High Court.
During the High Court proceedings, both the petitioner and the respondent passed away, and their legal heirs did not come forward to be substituted as parties. The court explained that under Order XXII, Rule 3 of the Civil Procedure Code, if no application is made to bring in legal representatives within the limitation period, the case does not automatically end (abate) - the court can still proceed and decide the matter, and such a decision remains valid even though a party has died.
This case is significant because it clarifies that the death of a litigant does not stall justice indefinitely, and courts can and must decide pending cases using the existing record when heirs fail to step in, ensuring disputes are not left unresolved.
