Zia Ud Din V. Khan Muhammad and 7 others,
PLD 2021 Balochistan 67 · Balochistan High Court
This case involved a property dispute in Pishin, Balochistan. The petitioner, Ziauddin, had earlier filed a civil suit (No. 09/2006) claiming his father's legacy property, which was decreed in his favor and fully acted upon. Later, he filed a fresh suit seeking possession of other portions of land connected to the same property and inheritance dispute, along with mesne profits (compensation for wrongful use of property) and a permanent injunction.
The defendants argued this second suit was barred by law because it was based on the same cause of action as the earlier, already-decided suit. Both the trial court and the appellate court agreed, dismissing the case under Order II, Rule 2 of the Civil Procedure Code, which prevents a person from splitting up a single claim into multiple lawsuits. If someone leaves out part of their claim in an earlier suit, either by choice or oversight, they cannot come back later and sue for that leftover portion separately.
The Balochistan High Court upheld these decisions, agreeing that Ziauddin's second suit was essentially trying to claim something he should have included in his first case back in 2006. Since he did not do so, and that earlier suit had already reached finality, he was legally barred from raising it again. The court dismissed his revision petition, finding no error in the lower courts' rulings.
This case matters because it reinforces an important procedural rule protecting defendants from repeated litigation over the same underlying dispute, ensuring that all claims from one dispute are settled together rather than split across multiple lawsuits.
