Muhammad Jaffar Magsi V. Sanaullah and 2 others,

PLD 2021 Balochistan 63 · Balochistan High Court

This case involved a dispute over whether police should be forced to register a criminal case (FIR) based on serious allegations. A man named Sanaullah accused the Assistant Commissioner of Jhal Magsi and a Levies official of coming to his house, beating two people, setting his hut on fire, illegally detaining the men for three hours, and causing valuable documents and a large sum of money to go missing. When the Levies police did not register an FIR, Sanaullah approached the Additional Sessions Judge acting as Ex-officio Justice of the Peace, asking for an order directing registration of the case.

The judge sought a report from the Tehsildar (a local official overseeing the Levies police), who investigated and found that no such incident had actually occurred in the area. Despite this report clearing the accused, the judge still ordered the FIR to be registered, without any supporting evidence from the complainant to contradict the official report.
